POWER OF ATTORNEY
A power of attorney is protection for you in the event you become unable to make important decisions while you are alive. For example, you may be in a coma. With a power of attorney, you appoint someone you trust to make decisions on your behalf, such as handling your financial affairs or taking responsibility for your medical care. We can draft a Power of Attorney that ensures your wishes are properly recorded and communicated.
PROBATE WITH OR WITHOUT A WILL
Probate is an approval process that validates a Will and confirms the appointment of an executor. Why is this needed? When one passes away, their chosen executor or loved one will need to access bank accounts and be able to dispose of property. A Probate Certificate proves that the executor has the authority to act for the estate of the Deceased. Many financial institutions and Real Estate transactions require a Certificate of Appointment/Probate Certificate before granting access to accounts or allowing land transfers to occur. This process can be complicated and involves careful drafting of court forms and affidavits for approval by a Judge. Whether you are a named executor in a Will or you wish to be appointed without a Will, we can assist in having your certificate issued by a Superior Court in Ontario.
